V28-578 : HOMELESS APPLICANTS - NON SECURE TENANCIES

The report of the Corporate Director (Community Services) reminded members of the Council's duty under the Housing Act 1996 (Part VII) to house homeless applicants. This was presently achieved by offering a Non Secure Tenancy, and the applicant placed on the Housing Waiting List. On their Waiting List turn being reached they were offered an Introductory Tenancy of either the property they were in or an alternative and after 12 months the Introductory Tenancy became a Secure Tenancy.

Problems had been experienced in the management of Non Secure Tenancies, in proving time consuming to set up and monitor and with Court action for rent arrears. This could be overcome by dispensing with Non Secure Tenancies, by giving those applicants to whom a duty is owed under the Act sufficient points to ensure immediate offer of an Introductory Tenancy.

RECOMMENDED

1. That the Policy relating to homeless applicants to whom a duty is owed under the Housing Act 1996 (Part VII) be amended from 2 January 2001, by dispensing with Non Secure Tenancies, giving applicants a sufficient number of points to ensure that they can be offered an Introductory Tenancy straight from the Waiting List.

2. That applicants with existing Non Secure Tenancies:
(a) who wish to remain in their existing dwellings be transferred into Introductory Tenancies
(b) who wish to move to alternative accommodation be granted an Introductory Tenancy and be given the assurance that their application will be treated as a management priority case for a move.
