V28-525 : 28 COTMER ROAD, LOWESTOFT - TREE PRESERVATION ORDER NUMBER 299

The report of the Corporate Director (Regeneration and Environment) advised that the above Order was made in August 2000 at the request of the landowner to protect a large number of mature trees set within the garden of a residential property. In total 57 trees were protected by the Order.

The property adjoined the recently constructed Richards Close development, and some of the protected trees were close to the boundary with these gardens, sometimes overhanging. The property owners had objected to the Order on grounds of root spread, surface water drainage, light reduction, falling branches and questioning the amenity value of the trees. However, by retaining control over the works carried out to any trees, the Council could ensure these were professionally supervised.

The trees were an important landscape feature in this urban location, and there was a strong amenity case for preserving them. The objections raised were not sufficient for the Order not to be confirmed.

RESOLVED

That Tree Preservation Order 299, 28 Cotmer Road, Lowestoft, be confirmed.
