UNAUTHORISED USE OF ANNEXE AS SEPARATE DWELLING
The report of the Corporate Director (Regeneration and Environment) advised that in 1988 permission was given to enlarge an existing detached garage at the above address in order to create a granny annexe, and a condition of approval was use "in association with the existing house only". Following enforcement appeal, the Government Inspector strengthened this condition to stipulate that "it shall not be occupied as a separate residential unit". A recent neighbour complaint had led officers to discover that the annexe was presently occupied by a couple unrelated to the applicant. There was no separate curtilage or access, and it would be wholly inappropriate to create a separate, very small, dwelling plot here. Enforcement action was needed to ensure the tenant left the property and any future breaches were controlled.
Before commencement of the debate Councillor Cracknell declared receipt of correspondence concerning the matter.
RESOLVED
That the Chief Executive be authorised to take all pursuant action to ensure compliance with condition no. 3 of Planning Permission T/APP/C/90/T3535/000016/P6 granted by the Planning Inspector, to prevent the use of an annexe at 17 Glebe Close, Lowestoft, as a self-contained dwelling.
