Application for change of use to A3 take-away food shop.
The report of the Corporate Director (Regeneration and Environment) outlined an application to which objections had been raised due to another A3 use not being required in this area, and because of current late night disturbance to residents by users of nearby night clubs. The proposal was for the ground floor conversion of the shop to provide an Indian take-away. The premises would be sub-divided with a food preparation area to the rear of the premises and a food servery to the front. A residential flat existed above the property, but it was the applicant's intention to live in the flat.
It was not proposed to make any external alterations, although an extraction flue would be sited on the rear wall of the property. If consent was granted, details of the extraction flue would be required before installation. The proposal complied with policy, and the applicant proposed to operate the takeaway between 5pm and 12 midnight, seven nights a week. These times were considered acceptable within this busy mixed use area, and unlikely to reduce residential amenity. The Director recommended approval subject to conditions relating to siting of the extraction flue and opening hours.
RESOLVED
That planning permission be granted to application W17724, subject to conditions relating to the siting of the extraction flue and opening hours.
