V28-399 : PLANNING APPLICATIONS REFERRED FOR DECISION

W9435/8 AND W9435/9 - VACANT SITE AT COMMERCIAL ROAD, LOWESTOFT

The report of the Corporate Director (Regeneration and Environment) dealt with a proposal for a 1,160 square metres discount foodstore at the above site. The site was outside the town centre and there were Local Plan and Government policies against such developments where there was likely to be an adverse impact on existing shopping areas.

However, the scale of the proposals and their location were judged not to harm the town centre, and the Government now afforded sufficient flexibility to allow Policy E2, which restricted non-industrial uses on such designated land, to be waived.

The Development Control Panel considered these applications at its meeting on 19 July 2000 and recommended approval subject to a Section 106 Agreement, better hard landscaping and referral to Secretary of State as departure from Local Plan. As this was a departure from Policy the matter was referred to The Executive for a decision.

Members concurred with the views of the Development Control Panel, but wished to see sufficient measures in place to ensure that both the hard and soft landscaping enhancements for this prominent site were in place before construction of the site commenced.

RESOLVED

That planning permission be granted for applications W9435/8 and W9435/9 subject to:

(a) The completion of a Section 106 Agreement requiring the proposed off site highway improvements in Station Square and Commercial Road to be completed before the retail store begins trading, incorporating the widening of Commercial Road;

(b) Better hard landscaping of the rear boundary, facing the south quay;

(c) An agreed scheme of hard and soft landscaping enhancements, with implementation before construction, to the satisfaction of the Head of Planning;

(d) Referral to the Secretary of State as a departure from the Local Plan.
