V28-383 : STOPPING-UP ORDERS - CARLTON COLVILLE BYPASS

The report of the Chief Executive dealt with an application received from Persimmon Homes Ltd to stop up three highways which would be affected by the construction of the Carlton Colville Bypass. The application also involved the creation of alternative routes to provide access to a crossing over the new road.

Two of the highways involved were vehicular highways and it was therefore necessary to ask the Secretary of State for the Environment, Transport and the Regions to make the Orders. The County Council had been consulted and agreed to the proposals. However, the Ramblers Association objected to the proposals and had notified the Council that they would formally object to any Order published.

It was therefore suggested that the best way to proceed would be to ask the Secretary of State to make the Orders and let the matter be decided at a full public inquiry.

RESOLVED

That the Chief Executive be authorised to apply to the Secretary of State for the Environment, Transport and the Regions, on behalf of Persimmon Homes Ltd, for highway stopping up orders under Section 247 of the Town and Country Planning Act 1990 in respect of Uplands Road, Hollow Lane and Public Footpath 8A, Carlton Colville.
