V28-324 : PUBLIC ENTERTAINMENT LICENCE, SWANSONS PH, BUNGAY
The report of the Chief Executive advised members that the decision made at the last meeting to refuse the renewal of the above Public Entertainment Licence for a further three month period should be changed. It was felt that if the applicant had appealed against the decision to the Magistrates Court, the Council at that time had insufficient evidence to defend a refusal decision.
The Licensee had accepted formal caution for two offences, previously therefore, the Licensing Panel of 27 April 2000 agreed to a three month renewal. With no further complaints received, advice had been to extend the Licence for a further three months to allow further monitoring to take place. The Chairman of the Panel, in consultation with the Chief Executive, agreed to overrule the decision and allow a further three month Licence to be issued.
The Chief Executive explained that the previous witnesses no longer resided in the vicinity and their evidence would not be available in defending any subsequent challenge. It was felt however that a clear message had been sent to the licensee.
RESOLVED
That the action of the Chief Executive, in consultation with the Chairman, in granting a further three month Public Entertainment Licence to Swansons PH, Bungay, be confirmed.
