V28-319 : SWANSONS PH, BUNGAY, PUBLIC ENTERTAINMENT LICENCE

The report of the Chief Executive detailed an application for a Public Entertainment Licence for the above premises. The premises had been the subject of numerous complaints of noise resulting in the service of Noise Abatement Notices. Numerous breaches of the Abatement Notices were witnessed but after a meeting with applicants a decision was made not to proceed with Court action. The licensee accepted formal cautions for two offences and indicated a willingness to work to resolve the problems under these circumstances.

At the Licensing Panel meeting held on 27 April 2000 members agreed that the Public Entertainment Licence be renewed for a period of three months in the first instance to allow further monitoring to take place.

Further observations had been received from the Police who had no objection to a further extension of the Licence. The Director of Housing and Environmental Services felt that although there had been no further complaints since the formal cautions, the nearest properties were empty flats, which when occupied, would undoubtedly be affected. The Director felt the Licence should be issued for a maximum period of three months to allow further monitoring to take place.

Although not an issue for the Panel to take into consideration, the Ward member expressed the grave concern of his constituents of alleged under-age drinking on the premises. Members felt the non-occupation of the nearby flats was possibly also related to the volume of noise from the Public House.

RESOLVED

That a further extension of the Public Entertainment Licence for Swansons PH, Bungay, be refused.
