Application for retention of conservatory at rear.

The report of the Corporate Director (Regeneration and Environment) set out a retrospective planning application for the erection of a conservatory built to the rear of an end of terrace property. The conservatory was constructed immediately adjacent to the neighbouring boundary fence. The main concern was this proximity to the neighbouring property, and potential loss of direct sunlight to ground floor windows.

At its highest point the conservatory measured just over a metre higher than the existing boundary fence and did have an impact on the neighbour as a result. Left in its existing state the extension could not be recommended, and to overcome the impact on the neighbour part of the conservatory should be removed or clear glazed, but the neighbour would need to be re-consulted on such a proposal. The Director recommended refusal and enforcement.

Rather than immediately refuse the application, members wished negotiations to take place on a reduced height or clear glazed conservatory which would not impact to such an extent on the neighbour. They were happy to delegate authority to the Director to approve a more acceptable design.

RESOLVED

That the Corporate Director (Regeneration and Environment) be given delegated authority to grant planning permission to an amended application W17673 incorporating a design which has a lesser impact on the neighbour.
