Application for the erection of a 1.65m high close-boarded fence.
The report of the Head of Planning reminded members that the above retrospective application had been deferred at the June meeting of the Panel for investigation into the ownership of the grass verge fronting the fence. This had still not been conclusively settled, however the applicant was adamant that the land was in his ownership and should be given the benefit of the doubt, as if the land was later found to be in the County Council's ownership, they would be able to require removal of the fence.
The property consisted of a detached dwelling set on a large corner plot and very prominent in the street scene when entering Black Street. The 1.65 metre fence was well built, but somewhat stark and at odds with the rural location. Retention of the fence would only be acceptable if, as suggested by the Parish Council, it was disguised with planting. Its close proximity to the road could, however, make this difficult to achieve. The Head of Planning recommended refusal with authority to take enforcement action.
In accordance with Standing Order 45(3) a non-member of the Panel, Councillor Sale, addressed the Panel in favour of the application, and stated that the applicant would be willing to paint the fence green until the planting took over.
Members understood that the applicant needed a fence or planting of some kind to create privacy for his property, and also realised that if the application was refused the applicant would be able to retain a one metre fence under permitted development rights. They were therefore minded to approve the application subject to the painting and planting outlined above.
RESOLVED
That planning permission be granted to application W11060/2, subject to climbing plants on the fence exterior and painting of the fence until the planting disguised it.
