Application for erection of rear conservatory.

The report of the Head of Planning advised that three letters of objection had been received expressing concern about the extension being a retrospective application, overlooking, height of conservatory, lighting and lack of screening. Construction of the house itself had been allowed on appeal in November 1995, with a condition of removal of permitted development rights.

The conservatory measured three metres by 3.6 metres and was flush with the side of the house, which was already set back from the neighbour's property. There was some impact on the adjacent neighbour due to the proximity to the boundary and the fact that the conservatory floor level stepped up from the garden.

However, the neighbour had sheds on the boundary and there was a five foot fence, and on balance the overall impact was not sufficient to warrant refusal. The Head of Planning recommended approval.

Members were minded to agree, but were concerned at the applicant's apparent lack of knowledge that he had no permitted development rights. They asked that in future, when plans for new properties came before planners, extensible areas be marked on the layout plan so that future owners would know when they needed to submit planning applications for proposals.

RESOLVED

That planning permission be granted to application W4706/9.
