V28-146 : KIRKLEY COMMUNITY RESOURCE CENTRE

The report of the Chief Executive reminded members that at its meeting on 27 July 2000 The Executive considered how it wished the Council to proceed in terms of its commitment to the Kirkley Community Resource Centre. The Executive resolved that, due to the potential financial commitment the Council was making, consideration be referred to the Council, with a recommendation for Option C as outlined in the Chief Executive's report, amended to guarantee the lease immediately on entering the agreement for lease.

A copy of the report made to The Executive on 27 July 2000 and an extract of the minutes of The Executive on 6 July 2000, when the matter was previously presented, were considered by members.

A full and frank debate took place in private under the grounds that there was the likely disclosure of exempt information as defined in paragraph 9 of Part 1 of Schedule 12A of the Local Government Act 1972, which referred to any terms proposed or to be proposed by or to the authority in the course of negotiations for a contract for the acquisition or disposal of property or the supply of goods or services.
On return to public session, the Leader of the Council proposed the following, and it was

RESOLVED

That the project carry on as proposed by Flagship, but it be written in that the Council enters into the Agreement for the lease and the subsequent lease in respect of the proposed Kirkley Resource Centre as guarantor, subject to:

(a) The grant of an option for purchase to the Council in the lease at a consideration of £1,000 plus VAT.

(b) No assignment of the lease or change of use of the premises without the Council's prior consent.

(c) Guarantee to be effective immediately on entering into the agreement for the lease.

Voting was by a recorded vote as follows:

For the motion Councillors R. Carter, T. Carter, Coward, Devereux, Gouldby, Gower, Graham, Hinton, Holzer, Hunter, Jones, Ley, Patience, Pitchers, Porter, Robertson, Rodgers, Rouse, Skipper, Taylor, Thomson, Thorne, J. Winterton and R. Winterton.

Against the motion Councillors Baxter, Bee, Bell, Cole, Cracknell, Crisp, Ford, Goldsmith, Groom, Langley, Niblett, Reader, Rose, Sale, Shepherd and Young.

Abstention None

The meeting was concluded at 8.55pm.
