Application for change of use from retail to restaurant.

The report of the Director of Planning and Building Control concerned the above application to which the Town Council objected due to noise and air pollution, impact on adjoining properties and car parking. Nine neighbours also objected for a variety of reasons including noise, litter, smell, mess, parking, no need for further restaurants and a need for more residential units in the town.

The premises had previously operated as a furniture shop, and the area was a mixed one, containing both residential and commercial properties. Two public car parks were within easy walking distance. Local Plan Policy permitted use for the sale of food and drink, and it would therefore be difficult to justify refusal of a change of use to restaurant in this location. However, use as a takeaway could result in problems with noise, parking and litter which would be unacceptably detrimental to the amenities of nearby residents, and likewise late night opening would cause disturbance.

Since the report was written, the applicant had confirmed that he would be happy with solely restaurant use. Neighbours had not yet been reconsulted, but disturbance would be much reduced from this use and the Director did not envisage any justifiable complaints being received. Before being allowed to open a restaurant on these premises, the applicant would have to demonstrate satisfactory disabled access and environmental considerations such as venting of cooking fumes and provision for bin storage. The Director recommended approval subject to no takeaway facilities being permitted.

RESOLVED

That planning permission be granted to application W713/7 for restaurant use only, subject to no takeaway facilities being permitted.
