V27-804 : FOOD TRADERS IN LONDON ROAD NORTH, LOWESTOFT
The report of the Director of Housing and Environmental Services reminded members that following receipt of three competing applications for street trading in "fast food" in the pedestrianised area of London Road North, it was resolved at the meeting of 18 October 1999, to offer all three applicants the opportunity to make personal representations to the Panel, explaining the merits of their proposals.
Members heard representations from the three applicants, Mrs N Beckley of 2A Winter Road, Norwich, Mr J Hare of 33 Baker Street, Gorleston and Mr G Robertson of 7 Fairfield Drive, Saxmundham, and discussed the merits of each in order to consider the issuing of once or more Licences to trade in that part of London Road North between Beach Road and Suffolk Road, Lowestoft. In addition, the Director circulated a letter received from the Lowestoft Town Centre Group of traders with their further view on the matter. RESOLVED
1. That permission be granted for one "fast food" stall only in the area specified, as it was considered there was not enough space for more and there were enough traders of similar goods in the street from nearby shops or otherwise to suffice. 2. That the Panel were minded to approve the Street Trading Licence application of Mrs Beckley in the terms of her application.
3. That the Panel were minded to refuse the Street Trading Licence applications of Mr Hare and Mr Robertson in the terms of their applications.
4. That the Director of Housing and Environmental Services be given delegated authority to serve Notice approving the application of Mrs Beckley.
5. That the Director of Housing and Environmental Services be given delegated authority to serve Notices refusing the applications of Mr Hare and Mr Robertson under paragraph 3(6)(a) and (b) of the Local Government Miscellaneous Provisions Act 1982, as it was considered there was not enough space for more than one stall and there were enough traders of similar goods in the street from nearby shops or otherwise to suffice. 6. That Mr Hare and Mr Robertson be served with formal notice under paragraph 6.2 of the Local Government Miscellaneous Provisions Act 1982 giving them the opportunity to make representations about the proposal to refuse their applications.
