V27-798 : STREET TRADING

The report of the Director of Housing and Environmental Services set out five applications for Street Trading Licences and four for Street Trading Consents which had been received further to the new policy on such licences and consents adopted at minute V27-107.

To facilitate decision on applications for London Road North, a map was supplied setting out the location of the proposed stalls. The Chief Executive advised that if the Panel were minded to refuse any application for a Licence, the applicants would be informed of a time and place where they could make representations before a formal decision was taken. The same would apply where the Panel was minded to approve an application for a Licence but in terms different to the application.

When the Street Trading policy was adopted, members had given a clear indication of the type of standards they expected to see on Licence Streets, particularly London Road North, appearance and location being the main issues. Where there was concern that stalls approved could spill over onto a larger footprint, it would be possible if necessary to put markings on the street outlining the maximum area the stall and its staff, waste bins etc could occupy. In any case, Licences would specify exact locations to avoid doubt.

The Panel then considered each application.

(a) Mr C Marshall, 44 Arbor Lane, Lowestoft
Street Trading Licence application for the sale of seasonal fruit.

The Panel indicated that it considered the description of "seasonal fruit" as being too vague and uncertain. The Panel informally indicated for the applicant's guidance that it would not object to a proposed sale of "fresh fruit and vegetables".

RESOLVED

1. That the Street Trading Licence application of Mr C Marshall, trading as Marshall's Produce, be deferred for negotiation of the design of the proposed stall, and for clarification on the nature of the produce to be sold.

2. That the pitch requested by Mr Marshall between Chadds and Barclays Bank be held pending receipt of such details.

(b) Mr S P Sansom, 6 Milton Road, Lowestoft
Street Trading Licence application for the sale of fresh flowers, artificial flowers, oasis and plants.

The Panel was minded to approve the application subject only to a variation relating to the location of the proposed stall.

RESOLVED

3. That the Director of Housing and Environmental Services be given delegated authority to approve the Street Trading Licence application of Mr S P Sansom, subject to the stall being a minimum of three metres from the wall adjacent to the childrens play area in London Road North.

4. That if Mr S P Sansom is not minded to agree to his application being amended as set out in resolution 3. above, he be given an opportunity to appear before the Panel to make representations, the Panel thereafter making a decision on the application.

(c) Mr P J Rush, 53 Saxon Road, Pakefield, Lowestoft
Street Trading Licence application for the sale of hot dogs, burgers etc. RESOLVED

5. That consideration of the Street Trading Licence application of Mr P J Rush be deferred for receipt of further information and negotiation on description of the goods proposed to be sold, design of the stall and times and days of proposed operations.

(d) Mr M Roydes, 7 Longbeach Drive, Carlton Colville, Lowestoft
Street Trading Licence application for the sale of burgers, sausages, bacon, filled rolls, tea, coffee and cold drinks.

RESOLVED

6. That Mr M Roydes, trading as Pakefield Fast Food, be advised that the Panel is minded to refuse his application on the grounds set out in paragraph 3(6)(b) of Schedule 4 to the Local Government (Miscellaneous Provisions) Act 1982, namely that there are already enough traders trading in the street from shops or otherwise in the goods in which the applicant desires to trade.

7. That Mr Roydes be served with a formal Notice under Paragraph 6(2)(a) of the 1982 Act giving him the opportunity to make representations about the proposal to refuse his application.

8. That the matter, with or without representations from Mr Roydes, be further considered at the next meeting of the Panel.

(e) Mr G Robertson, 7 Fairfield Road, Saxmundham
Street Trading Licence application for the sale of hot dogs, jumbo hot dogs, burgers, cheese burgers, tea, coffee, soft drinks and onions.

RESOLVED

9. That consideration of the Street Trading Licence application of Mr G Robertson, trading as "Mr Sizzle", be deferred pending negotiations for a more acceptable stall design.

10. That Mr Robertson be informed that, should the Panel be minded to approve his application, the only acceptable location for his stall will be his third choice, between Beach Road and Suffolk Road on London Road North, the exact location to be agreed, and that at this stage Mr Robertson be invited to amend his application accordingly.

(f) Mrs P Jackson, The Pantiles, 20 Covert Road, Reydon, Southwold
Street Trading Consent application for the sale of scooped ice cream in cones, tubs, and when in season summer fruits with ice cream and meringue nests, toppings and flakes.

RESOLVED

11. That all Street Trading Consents in respect of the Greens, Southwold, be restricted to trading from the paved or metalled paths only, and not from grassed areas, and from non-motorised vehicles or any associated trailers.

12. That the Housing and Environmental Services Committee be requested at the time of the next review of the Street Trading policy to give consideration to the designation of the Greens, Southwold as prohibited streets.

13. That the Street Trading Consent application of Mrs P Jackson be approved in the terms of her application.

(g) Mr D Roberts, 8 Elms Lane, Wangford
Street Trading Consent application for the sale of fish, chips, sausages, fish cakes, scampi, beef cutlets and canned drinks.

RESOLVED

14. That the Street Trading Consent application of Mr D Roberts, trading as Dennis's Fish and Chips, be approved in the terms of his application.

(h) Mr M Roydes, 7 Longbeach Drive, Carlton Colville, Lowestoft
Street Trading Consent application for the sale of scooped ice cream.

RESOLVED

15. That the Director of Housing and Environmental Services be given delegated authority to approve the Street Trading Consent application of Mr M Roydes, subject to the receipt of further details concerning locations from which trading is to take place, such details to be satisfactory to the Director.

(i) Mr P Parravani, Willow Lodge, Chedgrave, Loddon, Norfolk
Street Trading Consent application for the sale of ice cream, ice lollies, drinks and confectionery.

RESOLVED

16. That the Street Trading Consent application of Mr P Parravani be approved in respect of one vehicle only, and that the Director of Housing and Environmental Services be authorised to agree the identity of the particular vehicle with the applicant.
