V27-404 : TOWN AND COUNTRY PLANNING (ENVIRONMENTAL IMPACT) (ENGLAND AND WALES)
REGULATIONS 1999
The report of the Chief Executive advised that the above regulations had recently been issued and contained detailed requirements for studies to be undertaken in relation to the development of land. It would now therefore be necessary, for every proposed development where the regulations applied, to decide whether or not an assessment was needed and to agree the scope of the information required.
Rather than take a detailed report to Committee on every occasion, the Chief Executive recommended that the Director of Planning and Building Control be given delegated authority to determine whether an environmental impact assessment was required for any application, and the scope of any assessment to be undertaken.
RESOLVED
1. That the Director of Planning and Building Control be given delegated authority to determine whether or not an environmental impact assessment is required under the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999.
2. That, in cases where in environmental impact assessment is necessary, the Director of Planning and Building Control be given delegated authority to determine the scope and extent of the assessment to be undertaken.
