Application for outline plot for dwelling and conversion of builders yard buildings to dwelling.

The report of the Director of Planning and Building Control considered the above application and outlined objections received relating to the development being refused on this plot in 1989, danger of a precedent being set, poor access and parking provision. The Parish Council had no objection. Councillor Gower advised that he had been on site and had spoken to the applicant.

The Director felt that granting consent for a modest residential property on the site would prevent it being used as a builders yard again in the future. The conversion of the main offices and stores building into a dwelling could be justified if consent was tied to an agreement extinguishing all existing use rights. However, the additional dwelling plot proposed under W3362/11 had no such justification, would not meet infill criteria and would be in a backland position. The Director recommended approval of application W3362/12 subject to a Section 106 Agreement extinguishing all previous builders yard use rights for the entire yard and removal of all other buildings, and refusal of application W3362/11.

However, members felt that approval should be granted to both applications, in order to discontinue use of the entire site as a builders yard.

RESOLVED

That the Director of Planning and Building Control be given delegated authority to grant planning permission to applications W3362/11 and /12, subject to the completion of a Section 106 Agreement extinguishing all previous builders yard use rights for the entire yard and removal of all other buildings.
