Application for residential development of 83 dwellings and garages, through road, construction of soak lake and roadworks to Dukes Drive.

The report of the Director of Planning and Building Control reminded members that at the last meeting of the Committee they had raised the issue of a revision to the proposals for a limited amount of residential development, on the basis that this relaxation could provide necessary funding to acquire sufficient land to accommodate surface water holding tanks and to ensure that the Chediston Street/Through Road junction could be realigned, to take priority away from Chediston Street.

The applicants had submitted an initial sketch scheme to the Highway Authority, who had advised of highway amendments which would be required. The realignment would involve further consideration of the previously agreed estate layout, and the applicants were not prepared to pursue this option. The Trustees who owned the land were also reluctant to agree such changes at this stage.

It was also unclear whether allowing a limited number of additional dwellings would generate the necessary funding to secure the required realignment. The dwellings and the realigned road on land outside the site would also amount to a departure from the Local Plan which would require a decision by the Planning and Transportation Committee and a further public consultation exercise. There was also the possibility of costs being awarded against the Council for non-determination of the application.

As the position was becoming so complicated, the Director recommended that discussions continue with the Trustees of the site concerning possible amendments, but that the proposals as submitted be accepted, subject to appropriate conditions and the successful completion of a Section 106 Agreement covering play equipment, commuted maintenance and supervision fees.

RESOLVED

That the Director of Planning and Building Control be given delegated authority to grant planning permission to application W14372/7, subject to appropriate conditions and the successful completion of a Section 106 Agreement covering play equipment, commuted maintenance and supervision fees.
