V27-1382 : W2230/4 - FERMOY STORES, JAY LANE, LOUND

The report of the Director of Planning and Building Control outlined continued substantial breaches of three conditions of a permission granted in 1993 for the above stores to sell animal foodstuff. The Council had taken enforcement action, and there were successful prosecutions in 1997 and 1998, but in spite of this the breaches had continued. As prosecution, with an increased fine on the second occasion, had not been effective, more stringent legal action was required.

RESOLVED

That the Chief Executive be authorised to seek an injunction and to take all pursuant action in respect of the continued breaches of Conditions 2, 4 and 5 of permission W2230/4, Fermoy Stores, Jay Lane, Lound.
