UNAUTHORISED ROOFING CONTRACTOR'S YARD

The report of the Director of Planning and Building Control reminded members of the reasons that a 1995 appeal against a refusal to renew previous consent for the above use was dismissed. The Inspector did not expect the Council to embark on immediate enforcement, which might be seen as harmful to a small business but wanted to send a signal that relocation had now become essential.

There had already been a successful prosecution following the failure to meet the enforcement action deadline in 1994. Since then the Council offered help with relocation but the owner felt any other site would cost too much or not have enough security. As he owned land at Henstead it was hoped this would provide the solution, but no application was ever made and the site allocated for housing in the Local Plan, making other uses unlikely.

The Director had clear evidence Beach Farmhouse was still being used as a depot for the business's vehicle fleet and for some storage and deliveries of materials. Despite an overgenerous period to relocate, it was clear that there was no intent to do so.

RESOLVED

That the Chief Executive be authorised to seek an injunction and to take all pursuant action to prevent the continued existence of an unauthorised roofing contractor's yard at Beach Farmhouse, Gisleham.
