V27-104 : APPLICATION TO VARY PUBLIC ENTERTAINMENT LICENCE

BROADLANDS HOTEL, BRIDGE ROAD, LOWESTOFT

The report of the Chief Executive outlined an application received to vary the hours of the Public Entertainment Licence for the above on Thursday nights from 12 midnight to 1.00 am.

The Chief Executive added that the Director of Housing and Environmental Services' response of no objection to the proposal was based on the fact that no complaints had been received and no evidence was available that activities within the premises would justify the Department in taking action under the Environmental Protection Act 1990.

However, in stating that, the Director recognised that the Department's potential for involvement was comparatively narrow, confined generally and as indicated to premises- based activities. The Director fully recognised that wider issues such as public order problems and residential disturbance occurring outside the premises and in the surrounding streets were both a legitimate concern of the Police and neighbouring residents and were not matters which were within the area of relevance or jurisdiction of his Department.

The premises were in a predominantly residential area, and for this reason members were minded to refuse the application. They also expressed concern at the hours of the nearby Wherry Hotel, and asked that these be taken into consideration during the review of the Council's policy on hours of Public Entertainment Licences which was to take place in the next municipal year.

RESOLVED

That the application to vary the hours of the Public Entertainment Licence for the Broadlands Hotel, Bridge Road, Lowestoft, be refused.
