LATE NIGHT REFRESHMENT HOUSE LICENCE

The report of the Chief Executive outlined a request by the owner of the above premises to extend his opening hours on 24 December until 2.00am on 25 December and 31 December until 2.00am on 1 January. The owner had already been granted planning permission to operate the takeaway side of his business for these extended hours.

The Police, the Director of Planning and Building Control and the Director of Housing and Environmental Services had no objections, however it was brought to members' attention that the owner had a successful prosecution brought against him earlier this year for persistently flouting his existing licensing conditions. Complaints from residents were also still being received, and the Chief Executive recommended refusal of the extension.

Members felt that allowing the extension on 31 December until 2am on 1 January would not add greatly to the noise and other nuisance likely to be suffered by residents of Oulton Broad on that night, because of the Government's Deregulation Order. However, this would not be the case on 24 December and the early hours of 25 December, and therefore members were minded to approve the extension for 31 December/1 January only.

RESOLVED

That the application to extend the Late Night Refreshment House Licence of Southern Fried Chicken, Bridge Road, Oulton Broad, be approved on 31 December 1999, until 2am on 1 January 2000, but that the similar application for 24 December/25 December 1999 be refused.
