V26-82 : PROPOSED PARTIAL EXTINGUISHMENT OF PUBLIC FOOTPATH 1, SOUTHWOLD

The report of the Chief Executive outlined an application under Section 118 of the Highways Act 1980 for the partial extinguishment of the above path to allow for the installation of a biological sewage treatment plant.

The Chief Executive reported and confirmed the views of Southwold Town Council that the existing path provided the only emergency access to the Harbour Inn and Sailing Club in the event of flooding, and consequences for the emergency services in that event. The Town Council had also suggested an alternative site for the treatment plant in the garden of the property. The Director of Planning and Building Control also opposed the application on the grounds that the path was a well used route, and that in the area involved the proposed reduction in width was unacceptable.

The Chief Executive reported correspondence with the applicant, who had agreed that were the treatment plant to be sited in his preferred location, it could be installed flush to ground level, thus needing no extinguishment of the path. In this event, the application as submitted could therefore be viewed possibly as merely an attempt to increase the curtilage of the property.

RESOLVED

That the application of Tillaland Ltd. for partial extinguishment at the rear of Blackshore Corner of Public Footpath No. 1, Southwold, be refused.
