V26-798 : W11123/30 - LAND OFF SWALLOWFIELDS, CARLTON COLVILLE

Application for construction of 80 dwellings and associated works.

The report of the Director of Planning and Building Control outlined a proposal for the erection of 80 dwellings, including 12 to be managed by Suffolk Heritage Housing. The proposal formed the latest parcel for housing development as included in the Waveney Local Plan and the site was comprised of farmland situated to the south of the Swallowfields residential development built as an earlier phase of the Bloodmoor Estate. The applicant had attempted to comply with the Suffolk Design Guide by creating an attractive neighbourhood effect and use of nine different housing styles. The proposals also included a large play area/open space. Access would be via Swallowfields, Long Beach Drive and Colsterdale, which had the capacity to take the extra traffic, until such time that the Bovis housing development to the east was in place, when a further access point would enable vehicles to use Deepdale, which was envisaged to be the main route to the site.

Ten objections and a petition had been received objecting to the use of Swallowfields and adjoining roads as the means of temporary access for construction traffic and to the completed site, however an alternative temporary access had been refused. The Director recommended approval subject to the imposition of appropriate conditions following the completion of a Section 106 Agreement covering play areas, secure affordable housing and a financial contribution to Phase 2b of the Carlton Colville Bypass.

Members were very concerned about the use of Swallowfields for temporary access due to nuisance caused to properties, which were near to the road, and the fact that there was on- street parking at present which could mean lorries mounting the pavement to gain access. They felt that further consultation should take place to try to find an alternative access, but that if this was not possible Swallowfields should be looked at with a view to improvements such as a one-way system to reduce nuisance.

The Director of Planning and Building Control advised that if the application was deferred the applicants may appeal to the Secretary of State, who would expect good justification for the delay, which would be difficult to justify in legal terms. The Chief Executive advised that if members were minded to defer, they should also give delegated authority to the Director of Planning and Building Control to approve the application in the event that the developer appealed.

RESOLVED

1. That consideration of application W11123/30 be deferred for further consultation between officers and the developer investigating an alternative temporary access to the site, or if this was not possible, improvements to Swallowfields.

2. That in the event that the applicant indicates an intention to appeal to the Secretary of State regarding the deferral, the Director of Planning and Building Control be given delegated authority to grant planning permission to application W11123/30, subject to the imposition of appropriate conditions following the completion of a Section 106 Agreement covering play areas, secure affordable housing and a financial contribution to Phase 2b of the Carlton Colville Bypass.
