V26-758 : ACCESS TO COUNCIL OWNED PROPERTIES

The report of the Director of Housing and Environmental Services informed members that there had been recent difficulties in gaining access to certain properties to undertake important gas servicing work.

Under Section 54 of the Housing Act 1985 the Council had the legal right to gain access to its properties, subject to the proper legal procedure being followed. However, it had been noted that in the past no delegated power had been rested to the Director to authorise service of the relevant Statutory Notice.

RESOLVED

That the Director of Housing and Environmental Services and the Head of Housing be given delegated authority:

(a) to sign a Notice under Section 54 of the Housing Act 1985 requiring access to Council owned properties; and

(b) thereafter to apply, if necessary, for an injunction should access continue to be denied.
