Application for change of use to maintenance depot for lorries.

The Sub-Committee considered the report of the Director of Planning and Building Control which considered the merits of the above application. Following further negotiations, the Director recommended approval, subject to the prior conclusion of a Section 106 Agreement, and provided that reinstatement of The Yard was to an acceptable standard. The Parish Council were now unanimous in their view to refuse the application as the applicant had ignored all previous instructions in resect.

The applicant's agent had concerns that the applicant's father was not prepared to sign the Section 106 Agreement as he was reluctant to dispose of old vehicle and buildings from his former business operated at The Yard. The Sub-Committee considered that every effort had been made to assist the applicant to retain his business within the village and this long running matter needed resolving. It was felt that a time limit should be imposed requiring the Section 106 Agreement to be signed by the end of the month, which if not met should be followed by legal action to cease the unauthorised business activates at the two sites.

RESOLVED

1. That the Director of Planning and Building Control be given delegated authority to grant planning permission to application W16796/1, subject to the prior conclusion of a Section 106 Agreement, and the reinstatement of The Yard to an acceptable standard.

2. That should the Section 106 Agreement not be signed by the end of April 1998 planning permission be refused to application W16796/1, and the Chief Executive be authorised to take legal action to ensure the cessation of the unauthorised use at The Yard and Laurel Farm, St James South Elmham.
