V26-1395 : 2 PRIORY COTTAGES, MUTFORD WOOD LANE, CARLTON COLVILLE
UNAUTHORISED BUSINESS
The report of the Director of Planning and Building Control concerned complaints received in late 1997 and again in October 1998 about a courier van business operating from this relatively remote semi-detached cottage. A Planning Contravention Notice revealed that two Transit vans and one Escort van were used, although it was admitted that five vans and a trailer were kept there. At a recent visit two vans were seen to be off the road due to accident damage, and the occupier stated that only two vans were presently used. The owner said that most of the business was operated directly by himself and that visits by other `employed' drivers was infrequent. The operation of the business was a material change of use, and the occupier would require planning permission. Requests for a planning application had been ignored.
The above was an unsuitable use to base at a cottage in an attractive rural setting accessed by narrow, winding roads, as well as harming the amenity of the attached cottage's occupiers. One vehicle operated by the occupier should be the maximum level of activity allowed, but the Director still felt that a planning application should be brought to Committee for members to decide for themselves what they felt an acceptable level of activity.
He recommended requesting an application from the occupier, but that if this was not forthcoming action should be taken.
RESOLVED
1. That the occupier of 2 Priory Cottages, Mutford Wood Lane, Carlton Colville, be requested to submit a planning application to regularise his use of the property as a courier business.
2. That if such an application is not forthcoming, the Chief Executive be authorised to take all pursuant action to ensure cessation of the use of the property as a courier business exceeding one vehicle being based at or calling at the site.
