V26-1218 : TREE PRESERVATION ORDER (NO. 266) 1998

LAND AT 277 YARMOUTH ROAD, LOWESTOFT

The report of the Director of Planning and Building Control concerned a recent request to fell a large pine in the front garden of the above property which had prompted officers to assess its general amenity value and that of a large eucalyptus tree adjoining. An order was subsequently made.

The owners objected to the order, saying that large boughs frequently broke off the pine tree, and that falling drops of resin damaged car paintwork. They also wanted to enlarge the driveway to allow both of the family's business vehicles, as well as private cars, to be able to manoeuvre more easily.

Officers did not agree that any of the above reasons should override the amenity case for preserving the pine tree. Appropriate surgery would remove the risk of dead branches falling and trees could not be condemned for their natural behaviour, eg leaf fall, sap dropping etc. The pine did not currently prevent on-site turning, assuming a normal level of domestic car use.

RESOLVED

That Tree Preservation Order (No. 266) 1998, 277 Yarmouth Road, Lowestoft, be confirmed, and that officers continue to advise the owner with regard to suitable tree surgery to increase safety.
