V26-1197 : MATTER ARISING FROM LAST MINUTES - W1373/10 - PROPOSED BUILDERS' YAR

The report of the Director of Planning and Building Control reminded members that approval was given to the above application at the previous meeting. A condition of that approval was a restriction on hours of operation, as advised by the Director of Housing and Environmental Services.

The applicants had applied to vary the condition on hours of operation, as they could not operate under such restrictions. The Director of Housing and Environmental Services was prepared to take a more flexible view, particularly as there had been no objections to the application, and the nearby residential area had been established close to the industrial estate for some 30 years.

Although it was possible that there could be some resident objections, members were asked for an urgent delegated decision in this particular case, unless important, unforeseeable new factors emerged before the consultation period expired on 2 February 1999.

Members were concerned at allowing work to be carried out on Sundays and Bank Holidays, but observed that the buildings where work would take place were at the frontage of the site, and that the existing Eastern Electricity site had no time restrictions. They were therefore minded to approve the recommendation.

RECOMMENDATIONS

That the Director of Planning and Building Control be given delegated authority to vary the condition of application W1373/10 restricting hours of operation, to allow longer working hours and work on Sundays and Bank Holidays, subject to no sustainable objections of substance emerging before the expiration of the consultation period.
