V26-1192 : FERMOY STORE, JAY LANE, LOUND - BREACH OF CONDITIONS
The report of the Director of Planning and Building Control advised that a Breach of Conditions Notice was served in 1995 on the above due to the continued display of various goods on the forecourt and advertisement of such to what was solely an approved animal feeds sale business. In 1996 the Planning Sub-Committee refused an application to allow more flexibility in the type of goods and where they could be displayed by relaxing certain conditions. Continued breaches led to two subsequent prosecutions.
Currently there were further breaches involving the display and sale of Christmas trees, holly wreathes etc. In spite of many previous warnings that these were illegal, there were also signs on the A12 to advertise this and encourage traffic to use the poor junction with Jay Lane. It was clear that the action to date was not effective and a stronger sanction needed.
RESOLVED
That the Chief Executive be authorised to seek an injunction to prevent further breaches of conditions of permission W2230/1, relating to Fermoy Store, Jay Lane, Lound. The meeting was concluded at 9.05pm.
