V26-1190 : BRAMBLEDOWN COTTAGE AND ADJACENT BUNGALOW MILL LANE, BARNBY
The report or the Director of Planning and Building Control advised that planning permission was granted for the construction of Brambledown Cottage and chalet dwelling on 10 August 1995, and for the construction of a bungalow on the adjoining site, W1362/12 on 1 August 1996 at Mill Lane, Barnby.
As recommended by the Highway Authority, Condition 3 attached to permission W1362/11 required the following, and a similar condition was attached to the approval given for W1362/12: "Prior to the hereby permitted development commencing a footway of a minimum width of 1.5 metres, shall be provided along the whole highway frontage of the site connecting up when the existing footway at the east of the site. Such a footway shall be constructed in accordance with details previously agreed with the County Council's Area Surveyor at Street Farm Road, Saxmundham".
At the request of the developer, and now occupier of Brambledown Cottage, the Highway Authority agreed that the construction of the footway could be delayed, until occupation of the house, to avoid potential damage to the surface of the footway by construction traffic. The dwelling had now been occupied for some time and it had emerged that the occupier had informed the Highway Authority that they were not prepared to carry out the footway work. The adjacent bungalow was also now occupied, and a footway not constructed along this site's frontage either.
RESOLVED
That the Chief Executive be authorised to serve Breach of Condition Notices and to take all pursuant action to secure compliance with Condition 3 of W1362/11 and Condition 2 of W1362/12.
