V26-1025 : W2867/12 - HAMILTON ROAD, LOWESTOFT - CAR SALES, PARTS FITTINGS
The report of the Director of Planning and Building Control concerned the above site, which received permission in 1989. Complaints had been received that parking had overspilled from the premises onto Newcombe Road and was reducing short-stay parking for others, and thereby indirectly affecting businesses.
The parking was legally on the public highway, and did not breach any planning conditions. However, a condition of the permission required the applicant to achieve a certain visibility splay at the site access, which meant partial demolition of one of the buildings which abutted the front boundary. This had not been carried out.
No action could be taken to prevent the legal parking of vehicles on the highway, however the Director felt that action to ensure compliance with the above condition may go some way to rectifying the problem.
RESOLVED
That the Chief Executive be authorised to serve a Breach of Condition Notice and to take all pursuant action to require compliance with condition No. 2 of W2867/12 to ensure safer access.
