V25-916 : UNITS 1-3 THE BOULEVARD, OULTON BROAD
The Director of Central Services reported that the use of Units 1/2 The Boulevard, Oulton Broad, was restricted to storage only in connection with the lessees business, which was day boat hire operated from Unit 4/5 The Boulevard. The use of Unit 3 The Boulevard was restricted to an art gallery and no other purpose. Planning permission had been granted in 1993 for Unit 3 to be used as an art gallery, but in addition to framed paintings and prints, crafts and holiday souvenirs were being offered, some on display outside the building. However, the Solicitor to the Broads Authority advised that in his opinion an art gallery which involved sales amounted to an ordinary retail use (Class A1 instead of D1) and that the Planning Authority could not therefore control or restrict sales of souvenirs. A complaint had now been received from the occupier of Unit 3 that Units 1 and 2 were being used for the display and sale of garden ornaments. The last use of this site was as a boat sales office and brokerage. A proposed use for the retailing of boating equipment was rejected in 1994, at the same time as a use for cycle hire was approved. The current retail use was therefore unauthorised. The Broads Authority had consistently sought to restrict introduction into these units uses which would be likely to change the distinctive character of The Boulevard and had asked the Council prevent the introduction of inappropriate retail uses in Units 1-3 The Boulevard. The strict enforcement of the use clause of Unit 3 was likely to mean that the business would cease trading, and for this reason, although enforcement was necessary, members asked that the matter be dealt with sensitively. RECOMMENDED
That the lessees of Units 1-3 The Boulevard, Oulton Broad, comply with the use clause on the lease failing which appropriate action be taken.
