V25-748 : INSURANCE CLAIMS ARISING FROM GRASS CUTTING INCIDENTS
The report of the Director of Central Services considered the Council's approach to the settlement of insurance claims arising from the use of grass cutting equipment. This followed recent press publicity where a claimant alleged that the glass in his door had been shattered by a stone propelled from a Council grass strimmer. The Council's practice was to refer all claims to its insurers without admission of liability. The insurer decided whether the Council had been negligent, and would defend any case where negligence was unproven. This protected the Council financially and claims were dealt with in accordance with the law. However, it did cause an element of adverse public relations in some cases. RECOMMENDED
That the Council's procedures in respect of insurance claims arising from grass cutting incidents remain unaltered.
