V25-614 : W4182/4 - DISUSED RAILWAY CUTTING, BETWEEN NORTH QUAY RETAIL PARK AN

Outline application for construction of a cycle track/footpath, including temporary storage of waste materials for fill.

This application had been deferred for a site meeting at the last meeting of the Sub-Committee.

The Director of Planning and Building Control reported that this application would link many important sites over a route between North Quay Retail Park and Yarmouth Road, Lowestoft. There had been an objection from Suffolk Wildlife Trust concerned with the major filling of the deeper parts of the cutting which would be necessary to make the path viable, which could be harmful to the flora and fauna which had been given free reign in certain areas for up to 30 years. Nearby residents were also worried about possible security risks if the top of the cutting was moved nearer their properties. However, the Director of Planning and Building Control felt that the works would make the cutting less of a secluded area and would be in greater use, thus deterring criminals.

There would be lighting along the pathway below bank level and improved fencing at the top of the bank. The recommendation of the Director of Planning and Building Control was for approval.

Members were not against the proposal in principle, but felt there were many concerns to be addressed before the scheme went ahead, including possible flooding problems from natural springs which emerged from parts of the route, the number of trees lost through infill and the content of the infill material itself. They also felt that as many people as possible should have their views heard, and that therefore public meetings should take place on the proposal.

The Sub-Committee was aware that the railway cutting had been bought by the Council to be used as a cycleway, and also that there were many negotiations to be carried out before any works commenced on site. This application was for outline approval only, and members were minded to grant permission at this early stage.

RESOLVED

That for the purposes of paragraph 4 (5) of the Town and Country Planning General Regulations 1976 planning permission be granted to application W4182/4.
