OVERNIGHT USE OF REAR SERVICE ROAD/YARD

It had been noted that there had been no compliance with a condition attached to permission W2863/11 in 1991, requiring a lockable barrier to be installed, preventing use of the service road by heavy lorries between 10.00 pm and 6.30 am. Although the site owners said that there was no reason for overnight deliveries, due to the retail units not being opened up until the morning, there had been occasional instances of late night HGV arrivals and drivers leaving engines running to keep cabs warm in winter. There had also been fly tipping from time to time of large items such as old sofas, which presumably arrived by vehicle.

The Planning and Environmental Health Officers had no record of any noise complaints attributable to this source over the six years since the condition was imposed. The condition was on a permission which simply released one unit from the overall non-food only restriction for the Park, to enable the Rainbow Superstore to open. Arguably it should have been imposed, if at all, on the original overall outline.

A barrier would hinder the Royal Mail depot's operations at the rear unless carefully placed and could also prejudice future development and land use options for the undeveloped rear land. The ability to serve a Breach of Conditions Notice ran until 2001. It was therefore suggested, in view of the lack of any serious problems recorded to date and uncertainty about the future of the rear land, that the situation be reviewed again when the latter is clarified and before 2001.

RESOLVED

That no action be taken concerning lack of a lockable barrier at North Quay Retail Park, Lowestoft, but that the situation be kept under review.
