SOUTHERN FRIED CHICKEN AND MANHATTEN PIZZA
RESOLVED
1. That under Section 100(A)(4) of the Local Government Act 1972 (as amended) the public be excluded from the meeting for the initial discussion of the above matter on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 12 of Part 1 of Schedule 12A of the Act. The Chief Executive advised members on the Council's legal position regarding the operation of a home delivery service from premises at Southern Fried Chicken and Manhatten Pizza, Bridge Road, Oulton Broad. The public were then invited back into the meeting. The Chief Executive reminded members that there was a condition requiring that serving the public from the above premises, which operated as a hot food takeaway, should stop at 12 midnight. In the past, originally with Committee permission on a trial basis, the proprietor operated a home delivery service. Under this arrangement there would be no public serving within the premises after 12 midnight, but telephone orders would be taken and hot food delivered to homes by order after 12. During the trial period, although the premises had been closed to customers, people could still be seen preparing deliveries inside the premises, giving the impression of being open and attracting people to the area. The former Planning Sub-Committee No. 1 therefore decided that the home delivery service should stop, and so instructed the proprietor under threat of prosecution if he continued. A letter had since been received from the proprietor asking the Sub-Committee to reconsider this decision. RESOLVED
2. That the home delivery service at Southern Fried Chicken and Manhatten Pizza, Bridge Road, Oulton Broad, be allowed to continue for a trial period of six months, between the hours of 12 midnight to 2am Friday and Saturday nights, subject to blinds covering the whole of the frontage from 12 midnight, signs being erected showing the premises to be closed to the public and home deliveries being made to residential properties only.
