V25-403 : THE DISTRICT OF WAVENEY (LOWESTOFT NO 21 (PART)) PUBLIC PATH DIVERSI

The Committee were reminded that the above Order was made by the Council on 1 August 1996 and duly advertised in the local press. The making of the Order provoked significant opposition and over 100 letters were received during the statutory objection period.

Accordingly, the matter was passed to the DoE and a Public Inquiry scheduled to take place on 11 February 1997 to decide the issue. Prior to the Inquiry, however, the Chief Executive found that a section of the diversion route for the path was not owned by the applicant, and therefore the Public Path Order regulations had not been complied with.

In the circumstances, the Inquiry was cancelled and extensive but negative enquiries were made to find the owners of the land in question. The DoE subsequently notified the Council that before they would hold a Public Inquiry they required the Order to be remade and advertised with site notices addressed to the owner of the land.

In view of the strong local feeling, the Chief Executive considered that it was important to re- advertise the Order as soon as possible to allow a full debate of the issues involved in the forum of a Public Inquiry.

RESOLVED

1. That the District of Waveney (Lowestoft No. 21 (Part)) Public Path Diversion Order 1996 be remade and advertised in accordance with the instructions of the Department of the Environment.

2. That the re-advertised Order be sent to the Department of the Environment after the expiry of the objection period with a request that a Public Inquiry be scheduled as soon as possible.
