V25-213 : INTRODUCTORY TENANCIES AND ALSO TEMPORARY REHOUSING OF HOMELESS APPL

The Sub-Committee were reminded that Introductory Tenancies had been adopted with effect from 1 April 1997, under the legislation of the Housing Act 1996.

Within the same legislation, the way the Council provided accommodation for homeless applicants, for whom it had a responsibility, was also affected. Such applicants would be rehoused in Council accommodation, on a non-secure tenancy, for a period of up to two years, unless their turn on the housing waiting list was reached in the normal way.

No authority existed for officers to issue notices to bring Introductory Tenancies or Non-Secure Tenancies to an end, or to apply to the Court for a Possession Order. The tenancy agreements, for secure, non-secure and introductory tenancies, would need to be countersigned by an officer.

RESOLVED

1. That the Director of Housing and Environmental Services, Head of Housing, or Principal Housing Officers be delegated to serve a Notice of Possession Proceedings, where necessary in respect of Introductory Tenancies.

2. That the Director of Housing and Environmental Services be delegated to make application to the Court for a Possession Order, where necessary and subject to any Review of the Council's decision to seek possession in respect of Introductory Tenancies.

3. That the Director of Housing and Environmental Services, Head of Housing, or Principal Housing Officers be delegated to serve a Notice to Quit, where necessary, in respect of non- secure tenancies.

4. That the Director of Housing and Environmental Services be delegated to make appropriate application to the Court for Possession on expiry of any Notice to Quit. 5. That all tenancy agreements should be countersigned by either the Principal Housing Officer (Contractor), Senior Housing Officer, Housing Officers, Senior Lettings and Advice Officer, or Homeless Officer as delegated, on behalf of the Council.
