V25-144 : APPEALS BY ALDI STORES LTD AND MOORFIELD ESTATES

Members were reminded that the appeal by Aldi Stores Ltd into the non determination of their application for a discount foodstore on the former British Rail workshop at Commercial Road, Lowestoft was scheduled to be heard at a local inquiry in June.

Aldi have now withdrawn the appeal. Following the earlier withdrawals by Granchester Group Plc's site at Tesco roundabout and Zephyr Cams Ltd's site at South Lowestoft Industrial Estate there was now no need for the June inquiry which had been cancelled.

These developments enhanced the opportunity to progress the redevelopment of the Station Site, the Council's preferred site.

An appeal by Moorfield Estates Ltd into the Council's refusal to approve two retail units and a drive through restaurant on North Quay retail park, because the development would prejudice the redevelopment of the Station Site, was to proceed, and would be heard at a local inquiry on 28/29 May.

Due to the late withdrawal of the Aldi appeal, costs were incurred in Counsel and retail experts fees. The Chief Executive was examining the possibility of recovering the costs from Aldi. In the meantime the fees needed to be paid, together with the fees for the Moorfield inquiry. The total costs involved would be in the region of £25,000.

RESOLVED

1. That the current position with regard to the Aldi and Moorfield inquiries be noted.

2. That the consultants and counsels fees in connection with the Aldi and Moorfield inquiries of approximately £25,000 be paid from budget reserves.
