V25-1353 : PUBLIC ENTERTAINMENT LICENCES - LICENSING CONDITIONS

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982

The report of the Chief Executive proposed a change to the licensing conditions of Public Entertainment Licences. In recent months matters had arisen requiring further clarification of an existing condition concerning the Sunday Observance Act 1780 and the need for a new condition requiring licensees to seek permission from the Council prior to using special effects. These would include pyrotechnics, smoke and foam.

The Chairman took the opportunity to request the Chief Executive to arrange the annual visit to nightclubs in Lowestoft licensed by the Council for public entertainment for members of the Licensing Panel in March/April 1998.

RESOLVED

1. That the condition concerning the Sunday Observance Act be amended as follows:-

"This Licence is granted subject to the provisions of the Sunday Observance Acts as modified by later statutory provisions (under this legislation where a charge for admission is made entertainment is restricted to musical entertainment only on a Sunday, no dancing must take place)."

2. That as from 1 January 1998 a new condition concerning special effects be added to all Public Entertainment Licenses as follows:-

"The Licensee must seek permission from the Licensing Authority prior to using any special effects on the premises. These include pyrotechnics, smoke and foam."

3. That a visit to nightclubs licensed as public entertainment premises in Lowestoft be arranged for Panel members for March/April 1998, and that attendance be authorised as an approved duty.
