V25-1284 : BYWAY 14 WESTON - PROPOSED DIVERSION
The report of the Chief Executive outlined an application from a Mr and Mrs Cook of Chenerys Farm, Weston to have a short section of Byway 14, Weston diverted from the middle of their garden to the boundary of their property. The procedure was normally administered by the County Council, but as the application had been submitted to the District Council the County Council had given delegated authority. The Ramblers Association, the Waveney Byway and Bridleway Association and Ringsfield and Weston Parish Council had been consulted on the proposal and had raised no objections subject to the proposed new route for the byway being established at a width of 3.0 metres. Ringsfield and Weston Parish Council also supported the case that the new route would be more commodious to the public in terms of its position, surface and landscaping. RESOLVED
1. That the Chief Executive be authorised to apply to the Magistrates Court for a diversion order under Section 116 of the Highways Act 1980 in respect of the section of Byway 14 Weston shown on the plan presented at Committee, and to take all pursuant action. 2. That the Chief Executive be authorised to apply to the Magistrates Court for a stopping up order under Section 116 of the Highways Act 1980 to reduce the width of the diverted section of Byway 14 to 3.0 metres.
