V25-1263 : W9700/7 - BLINDMANS GATE GARAGE, BARNBY

The report of the Director of Planning and Building Control examined the situation at the above site, following concerns expressed by Barnby Parish Council about its appearance and the intensity of use of the premises. The site was currently leased to three separate businesses; a petrol filling station, car repairs, and car sales.

The car sales use was challenged in 1996 when the lease changed hands and the use appeared to intensify from the previous low-key, ancillary sales. The site owner had produced documents which strongly suggested that the use could qualify for a lawful use certificate, and the matter was not pursued.

Existing problems had arisen because too many cars were being displayed for sale. Those which could not be accommodated in the compound were being displayed on the road verge, site frontage, and parts of the petrol station forecourt. This was objectionable as the sales advertisements were a serious distraction to drivers at an accident blackspot, plus, the vehicles took up space which would be needed for parking for the enlarged car repair operation, although no details of parking had been submitted to comply with Condition 2 of the permission.

The Highway Authority was investigating the extent to which encroachment on to the public highway was taking place and their findings were reported at the meeting.

RESOLVED

1. That the Highway Authority be asked to bring prosecution action against any display of cars for sale on highway land and Blindmans Gate Garage, Barnby.

2. That the Chief Executive be authorised to serve an Enforcement Notice and to take all pursuant action against display of cars for sale other than on the original site.

3. That a Breach of Condition Notice be served on the car repairs operation for failure to comply with Condition 2 of W9700/7 relating to details of parking.

4. That the Chief Executive be authorised to serve an Enforcement Notice and to take all pursuant action to ensure the removal of an unauthorised caravan at the site.
