V25-1227 : W14483/1 - HOLLY COTTAGES, FLIXTON
The Director of Planning and Building Control reported that in November 1989 planning permission was granted for the sub division of Holly Cottage in Flixton, to form two dwellings. In considering the application, it was felt that the original vehicular access to the north of the dwellings presented a highway danger therefore a scheme was devised consisting of a shared driveway to the south of the cottages with areas allocated for parking at the rear of the site. The application was approved subject to conditions requiring the development to be carried out in accordance with the plan showing the common access and parking areas and the vehicular access to be laid out and retained in the approved form. The occupiers of 2 Holly Cottages wished to erect a fence along the centre of the drive from their back door and around their allocated parking area. This was considered unsatisfactory in highway safety terms as a shed and greenhouse had been erected on their parking area, necessitating the reversal of cars. The occupiers of 2 Holly Cottages had been informed that it was highly unlikely that a proposal to vary the approved layout would be looked upon favourably and that they were also in breach of the planning consent because the area allocated for parking their vehicles was not available. It had also been noted that the occupiers of 1 Holly Cottages were in breach of the planning permission as they parked one vehicle in their allocated space and left one vehicles on the shared access driveway. The County Director of Environment and Transport representative had visited the site and did not wish to seek relaxation of the turning and parking standards because of the highway safety implications. The Director had been informed that the owners of 2 Holly Cottages were buying the land adjacent to the shared access and there would be future potential for turning space. Since the application was approved a 30 mph speed limit had been imposed on The Street giving potential use for the land adjacent to 1 Holly Cottages as a future access. Members were hopeful that this matter could be resolved in some way in the near future without the need for action and asked the Chief Executive to take a delayed approach. RESOLVED
That the Chief Executive be authorised to serve a Breach of Condition Notice on the occupiers of 1 and 2 Holly Cottages, Flixton, and take all pursuant action to secure compliance with the conditions of consent W14483/2 relating to the access and parking areas, with a deferred action of six months.
