V25-1214 : W3250/37 - LAND ADJACENT TO A12/A1117 ROUNDABOUT, PAKEFIELD, LOWESTO

The Director of Planning and Building Control reported that previous applications for a drive- through restaurant with sit down and standard takeaway at Arbor Lane had raised landscape, safety, disturbance and highway issues. These had been addressed by the latest application, though local residents were still clearly opposed to the principle. The applicants had appealed over the previous decision, and also submitted a fresh application in order to explain and justify their proposals more fully, addressing the concerns set out in the Council's refusal reasons. This reinforced officers' advice that there were no sound and clear-cut planning reasons to refuse this proposal. Sixteen neighbours objections and the concerns of Pakefield Middle School were reported, along with a petition of support from the neighbouring mobile homes site.

Members were reluctant to approve the application, but agreed that although moral issues were in question, planning law did not address this. Members expressed regret that the application site had not been safeguarded as an area of open space by the Local Plan. It was felt that this latest scheme, with the addition of extra vegetation screening particularly on the southern approach and with low level signage, was the best compromise available.

The Leader of the Council added that given the authority's main priority of job creation, the likelihood of 60 new jobs being created by the application should also not be overlooked.

RESOLVED

That planning permission be granted to application W3250/37, subject to conditions regarding no unnecessary vegetation removal, landfill gas to be at safe levels before work starts on site and all signage to be approved beforehand.
