V25-1026 : WORLINGHAM HALL, WORLINGHAM
This item was considered as a matter of urgency, under the statutory provision accorded to the Chairman, as authority was needed to take immediate action in respect of this situation. The Director of Planning and Building Control had recently been advised by the occupier of Worlingham Court that the new owners of Worlingham Hall were intending to sub-divide the parkland surrounding the Hall into two ownerships. The occupier was concerned that the new owners would trespass upon her land and intended to erect a chainlink fence.
The Director considered that chainlink fencing would be alien to this parkland setting and a listed building, and consent was required. However, the only form of control over this development was an Article 4 Direction which would remove permitted development rights.
The serving of an Article 4 Direction would take immediate effect and last for six months, only becoming permanent if confirmed by the Secretary of State. The Chief Executive was currently looking into compensation rights.
RESOLVED
That the Chief Executive be authorised to serve an Article 4 Direction on the occupier of Worlingham Court to cease the erection of chainlink fencing.
