V25-1021 : LAND TO THE REAR OF THE DENE AND THE CROFT (NO.2)
LOWESTOFT ROAD, WORLINGHAM
The Director of Planning and Building Control informed members that planning permission was granted in December 1985 for the development of three residential plots on land to the rear of The Dene and The Croft (No.2), Lowestoft Road, Worlingham.
Condition 4 attached to the outline planning permission W12446/2 required the completion of a new vehicular access prior to the development being commenced. At this time all other means of vehicular access within the A146 road frontage would be stopped up.
Although this development had been completed for some time the vehicular access arrangements had not been properly complied with. In particular the property known as The Dene had not stopped up the original vehicular access onto the A146 and continued to use it as the only vehicular access serving the site.
The current occupiers asserted that the access requirement was not drawn to their attention at the time of purchase in 1991. They were unable to explain why the access conditions had not been complied with but argued that these should have been met when the development was being carried out. There was now a 30mph speed limit on this road and they felt their use of the access had not presented any difficulties or dangers in the six years they had lived there.
It was suggested in view of these circumstances and the long lapse of time that no further action be taken. The County Surveyor concurred with this view.
RESOLVED
That no action be taken in respect of the non-compliance with Condition 4 of W12446/2 relating to access arrangements at land to the rear of The Dene and The Croft (No. 2), Lowestoft Road, Worlingham.
